Please read these Terms of Service ("Terms") carefully before purchasing or using the Word River mobile application ("App"), operated by Fixie Labs ("Company," "we," "us," or "our"). These Terms govern your access to and use of the App.
1. Acceptance of Terms
By purchasing, downloading, installing, or using Word River, you agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use the App. Your continued use of the App following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Description of Service
Word River is a mobile application designed to help parents and caregivers track their child's speech and language development. The App provides tools to log words, monitor vocabulary growth, share tracking responsibilities with other caregivers, export data, and receive AI-generated insights about language development patterns.
Word River is an informational tool intended to support caregiver awareness. It is not a medical device, diagnostic tool, or clinical service.
3. Account Registration
To use Word River, you must create an account using either an email address and password or Apple Sign-In. You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
Each account is intended for use by a single individual. You agree to notify us promptly of any unauthorized use of your account.
4. Acceptable Use
You agree to use the App only for its intended purpose and in compliance with all applicable laws. You may not:
- Use the App for any unlawful, harmful, or fraudulent purpose.
- Attempt to gain unauthorized access to any part of the App, its servers, or any systems or networks connected to the App.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Modify, adapt, translate, or create derivative works based on the App.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App.
- Use the App in any manner that could disable, overburden, damage, or impair the service.
- Use automated scripts, bots, or other means to interact with the App.
5. User Content
You retain full ownership of all data you enter into the App, including word logs, notes, and any other information you provide ("User Content"). By using the App, you grant Fixie Labs a limited, non-exclusive, non-transferable license to store, process, and display your User Content solely for the purpose of providing and improving the App's functionality.
You may export your data at any time in CSV format. You may delete your account and associated data at any time through the App's settings.
We will not sell, share, or distribute your User Content to third parties except as described in our Privacy Policy or as required by law.
6. AI-Generated Content
Word River includes features that use artificial intelligence to generate insights, tips, and observations about your child's language development ("AI-Generated Content"). You acknowledge and agree that:
- AI-Generated Content is provided for informational purposes only.
- AI-Generated Content does not constitute medical advice, clinical diagnosis, or professional speech-language pathology guidance.
- AI-Generated Content may not be accurate, complete, or applicable to your child's specific situation.
- You should consult a licensed speech-language pathologist (SLP) or other qualified healthcare professional for any concerns about your child's speech and language development.
- Fixie Labs does not guarantee the accuracy or reliability of AI-Generated Content and assumes no liability for actions taken based on such content.
7. Medical Disclaimer
Word River is not a medical device. The App is not a diagnostic tool and is not intended to diagnose, treat, cure, or prevent any condition or disorder. The App is not a substitute for professional speech-language pathology services, medical advice, or clinical evaluation.
The information provided through the App, including AI-generated insights, is intended for general informational purposes only. If you have concerns about your child's speech, language, or overall development, you should seek the advice of a qualified healthcare provider or licensed speech-language pathologist.
Never disregard professional medical advice or delay seeking it because of information obtained through the App.
8. Intellectual Property
The App, including its design, features, code, graphics, logos, and all related content (excluding User Content), is the property of Fixie Labs and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, Fixie Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, for your personal, non-commercial use.
This license does not grant you any rights to use the Fixie Labs or Word River name, logos, or trademarks without prior written consent.
9. Payment and Refunds
Word River is available for a one-time purchase price of $9.99 (USD) through the Apple App Store. All payment processing is handled by Apple. By purchasing the App, you agree to Apple's terms and conditions regarding payment.
Refund requests are handled exclusively by Apple in accordance with their refund policy. Fixie Labs does not process payments or issue refunds directly. If you wish to request a refund, please contact Apple Support or submit a request through your Apple account.
10. Termination
Either party may terminate this agreement at any time.
- By you: You may stop using the App and delete your account at any time through the App's account settings. Upon account deletion, your User Content will be removed in accordance with our Privacy Policy.
- By us: We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to the App, other users, or Fixie Labs.
Upon termination, your license to use the App is revoked. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to Sections 7, 11, 12, 13, and 14.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Fixie Labs, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the App, even if Fixie Labs has been advised of the possibility of such damages.
In no event shall the total liability of Fixie Labs to you for all claims arising from or related to your use of the App exceed the amount you paid for the App.
12. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. Fixie Labs expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Fixie Labs does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Fixie Labs does not warrant the accuracy, completeness, or usefulness of any information provided through the App, including AI-generated insights.
Your use of the App is at your sole risk.
13. Indemnification
You agree to indemnify, defend, and hold harmless Fixie Labs, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the App.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any User Content you submit, post, or transmit through the App.
- Any decisions or actions you take based on information or AI-Generated Content provided by the App.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the State of New York, and the parties consent to the personal jurisdiction and venue of such courts.
15. Changes to Terms
Fixie Labs reserves the right to modify or update these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this document. We may also notify you of significant changes through the App or via email.
Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the App and delete your account.
